1.Special Notices

Welcome to Nova (the “Platform” or “Nova”). You are reading the terms of service (the “Agreement”), which govern the relationship and serve as an agreement between you and us and set forth the terms and conditions by which you may access and use the Platform and our related websites, services, applications, products and content (collectively, the “Services”). Our Services are provided for private, non-commercial use. For purposes of these Terms, “you” and “your” means you as the user of the Services. The Terms form a legally binding agreement between you and us. Please take the time to read them carefully.

The Services are not for use by anyone under the age of 16. To use the Services, you agree that:

(1) you must be the "Minimum Age"(described below) or older; and
(2) you are not already restricted by Nova from using the Services. Creating an account with false information is a violation of our terms, including accounts registered on behalf of others or persons under the age of 16.

“Minimum Age” means 16 years old. However, if law in your jurisdiction requires that you must be older than Minimum Age in order for Nova to lawfully provide the Services to you without parental consent (including using of your personal data) then the Minimum Age is such older age.

You shall be solely responsible for the safekeeping of your Nova account and password. All behaviors and activities conducted through your Nova account will be deemed as your behaviors and activities for which you shall be solely responsible.

We do not accept payments or do business with individuals or entities in Cuba, Iran, North Korea, Sudan, Syria, and the Crimean region. If you are from such regions, you may be prohibited from using the Services.

2.Services Content

Our mission is to give people the power to build community, connect the world and share their beautiful moments. To help advance this mission with a vision to be a content platform inspiring one billion people's lives, we provide the services described below to you:

i. User Generated Content.
Nova allows users to distribute streaming live, use services, such as chat, bulletin boards, forum postings, voice interactive services, and to participate in other activities in which you may create, post, transmit, perform, or store content, messages, text, sound, images, applications, code or other data or materials on the Services (“User Content”). Users of the Services may also overlay music, graphics, stickers, virtual items and other features provided by Nova (“Nova Features”) onto this User Content and transmit this User Content through the Services. The views expressed by other users on the Services (including through use of the virtual gifts) do not represent our views or values.

ii. Help you discover content, products, and services that may interest you.
We show you ads, offers, and other sponsored content to help you discover content, products, and services that are offered by the many businesses and organizations that use Nova.

iii. Combat harmful conduct and protect and support our community.
We employ dedicated teams around the world and develop advanced technical systems to detect misuse of our Services, harmful conduct towards others, and situations where we may be able to help support or protect our community. If we learn of content or conduct like this, we will take appropriate action - for example, offering help, removing content, removing or restricting access to certain features, disabling an account, or contacting law enforcement.

iv. Global access to our Services
To operate our global service, we need to store and distribute content and data in our data centers and systems around the world, including outside your country of residence. This infrastructure may be operated or controlled by Bigo Technology Pte. Ltd. and its affiliates.

3.Account

In order to open an account, you will be asked to provide us with certain information such as an account name and password.

You are solely responsible for maintaining the confidentiality of your account and password, for restricting access to your computer, and for all activities that occur under your account or password. Please make sure the information you provide to Nova upon registration and at all other times is true, accurate, current, and complete to the best of your knowledge.

We may permit you to register for and log on to the Services via certain third party services. The third party’s collection, use and disclosure of your information will be subject to that third party service’s privacy policy. Further information about how Nova collects, uses and discloses your personal information when you link your Nova account and with your account on any third party service can be found in our Privacy Policy.

We reserve the right to disable your user account at any time, including if you have failed to comply with any of the provisions of these terms, or if activities occur on your account which, in our sole discretion, would or might cause damage to or impair the Services or infringe or violate any third party rights, or violate any applicable laws or regulations.

If you no longer want to use our Services again, Please contact us via Novachatservice@gmail.com, and we will provide you with further assistance and guide you through the process. Once you choose to delete your account, you will not be able to reactivate your account or retrieve any of the content or information you have added. Learn more about your right to erasure and deletion of your personal information in our Privacy Policy.

4.Privacy

Your privacy is important to Nova. Please see our Privacy Policy for information relating to how we collect, use, and disclose your personal information, and how you can manage your online privacy when you use the Services.

5.Use of the Services

Your access to and use of the Services is subject to these terms and all applicable laws and regulations. You agree that you will comply with these terms of Services and Nova’s Community Guidelines and will not:

i. create, upload, transmit, distribute, or store any content that is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable;

ii. impersonate any person or entity, falsely claim an affiliation with any person or entity, or access Nova accounts of others without permission, forge another person’s identity, or content of information transmitted via the Services, or perform any other similar fraudulent activity;

iii. defame, harass, abuse, threaten or defraud users of Nova, or collect, or attempt to collect, personal information about users or third parties without their consent;

iv. remove, circumvent, disable, damage or otherwise interfere with security-related features of the Services or User Content, features that prevent or restrict use or copying of any content accessible through the Services, features that enforce limitations on the use of the Services or User Content, or delete the copyright or other proprietary rights notices on the Services or User Content;

v. reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Services or any part thereof, except and only to the extent that this activity is expressly permitted by the law of your jurisdiction of residence;

vi. modify, adapt, translate or create derivative works based upon the Services or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;

vii. interfere with or damage operation of the Services or any user’s enjoyment of them, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code;

viii. manipulate identifiers in order to disguise the origin of any User Content transmitted through the Twitch Services;

ix. interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services; use the Services in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden or impair the functioning of the Services in any manner;

x. attempt to circumvent any content filtering techniques we employ, or attempt to access any service or area of the Services that you are not authorized to access;

xi. use the Services for any illegal purpose, or in violation of any local, state, national, or international law or regulation, including, without limitation, laws governing intellectual property and other proprietary rights, data protection and privacy.

Nova takes no responsibility and assumes no liability for any User Content or for any loss or damage resulting therefrom, nor is Nova liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter when using the Services. Your use of the Services is at your own risk. In addition, these rules do not create any private right of action on the part of any third party or any reasonable expectation that the Services will not contain any content that is prohibited by such rules.

Nova is not liable for any statements or representations included in User Content. Nova does not endorse any User Content, opinion, recommendation, or advice expressed therein, and Nova expressly disclaims any and all liability in connection with User Content. To the fullest extent permitted by applicable law, Nova reserves the right to remove, screen or edit any User Content posted or stored on the Services at any time and without notice, including where such User Content violates these terms of Use of the Services or applicable law, and you are solely responsible for creating backup copies of and replacing any User Content you post or store on the Services at your sole cost and expense. Any use of the Services in violation of the foregoing violates these terms of Use of the Services and may result in, among other things, termination or suspension of your rights to use the Services.

6.Virtual Items

You can only buy virtual Coins (“Coins”) and virtual gifts (Gifts), send Gifts to others, receive Gifts with monetary value, earn virtual beans (“Beans”) and withdraw Beans if you are aged 16 (or age of majority in your jurisdiction) or older.

The price of the Coins will be displayed at the point of purchase. All charges and payments for Coins will be made in the currency specified at the point of purchase through the relevant payment mechanism. Currency exchange settlements, foreign transaction fees and payment channel fees, if any, are based on your agreement with the applicable payment provider.

You will be responsible for the payment of any Coins purchased by you. Once your purchase has been completed, your user account will be credited with Coins. Coins can be used to purchase Gifts. Coins cannot be exchanged for cash, or legal tender, or currency of any state, region, or any political entity, or any other form of credit. Coins can only be used on Nova and as part of our Services, and cannot be combined or used in conjunction with other promotions, coupons, discounts or special offers, except those designated by us.

Except as otherwise set out in this Agreement, all sales of Coins and Gifts are final, and we do not offer refunds for any purchased Coins and Gifts. Coins and Gifts cannot be converted into or exchanged for cash, or be refunded or reimbursed by us for any reason.

7.Payment Terms

We accept major credit cards, certain debit cards and/or such other payment methods we may make available to you from time-to-time through our site, as forms of payment. You are subject to all terms and conditions of the payment method you choose. By submitting an order through the Service, you authorize us, or our designated payment processor, to charge the account you specify for the purchase amount. All payments are to be made in United States Dollars, except where other currencies are offered via the payment methods made available by Nova.

Our payment processing partners may request that you provide certain personal data (e.g., a valid government issued ID, your legal name, address, and date of birth) for the purpose of making payment through its financial institutions and complying with applicable international, national, federal, state, and local laws and regulations. They may also communicate directly with you regarding any issues with a payment.

If a purchase has been declined online due to issues with your payment method, please ensure all data is correct and resubmit. If the transaction is not accepted online, please contact customer support via the email address made available to you in connection with the purchase. 8.Intellectual Property Rights

All text, data, images, graphics, audio and/or video information and other materials within the Services provided by Nova are property of Nova are protected by copyright, trademark and/or other property rights laws. Nothing in this Agreement shall be construed as conferring any license of any intellectual property rights or such materials by Nova to you.

By using and/or uploading any live stream content or other content through a Nova Services to publicly accessible areas of Nova website, you grant to Nova and its sub-licensees the permission, free, permanent, irrevocable, non-exclusive and fully sub-licensable rights and license, without any territorial or time limitations and without requiring any approvals and/or compensations, to use, copy, modify, adapt, publish, translate, edit, dispose, create derivate works of, distribute, perform and publicly display such content (in whole or in part), and/or incorporate such content into existing or future forms of work, media or technology.

9.Terminating Services

To the fullest extent permitted by applicable law, Nova reserves the right, without notice and in our sole discretion, to terminate your license to use the Services (including to post User Content), and to block or prevent your future access to and use of the Services, including where we reasonably consider that: (a) your use of the Services violates this Agreement or applicable law; (b) you fraudulently use or misuse the Services; or (c) we are unable to continue providing the Services to you due to technical or legitimate business reasons. This includes the ability to terminate or to suspend your access to any purchased products or services. To the fullest extent permitted by applicable law, your only remedy with respect to any dissatisfaction with (i) the Services, (ii) any term of these terms of Services, (iii) any policy or practice of Nova in operating the Services, or (iv) any content or information transmitted through the Services, is to terminate your account and to discontinue use of any and all parts of the Services.

10.Disclaimers

You shall be fully responsible for any risks involved in using Nova Services. Any use or reliance on Nova Services will be at your own risk.

Under no circumstance does Nova guarantee that the Services will satisfy your requirements, or guarantee that the Services will be uninterrupted. The timeliness, security and accuracy of the Services are also not guaranteed. You acknowledge and agree that the Services is provided by Nova on an “as is” basis. Nova make no representations or warranties of any kind express or implied as to the operation and the providing of such Services or any part thereof. Nova shall not be liable in any way for the quality, timeliness, accuracy or completeness of the Services and shall not be responsible for any consequences which may arise from your use of such Services.

Nova does not guarantee the accuracy and integrity of any external links that may be accessible by using the Services and/or any external links that have been placed for the convenience of you. Nova shall not be responsible for the content of any linked site or any link contained in a linked site, and Nova shall not be held responsible or liable, directly or indirectly, for any loss or damage in connection with the use of the Services by you. Moreover, Nova shall not bear any responsibility for the content of any webpage that you are directed via an external link that is not under the control of Nova.

Nova shall not bear any liability for the interruption of or other inadequacies in the Services caused by circumstances of force majeure, or that are otherwise beyond the control of Nova. However, as far as possible, Nova shall reasonably attempt to minimize the resulting losses of and impact upon you.

11.Legal Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of HongKong.

12.Request for information

All requests for information or documents related to potential, anticipated or current legal proceedings, investigations or disputes, or for third party user information, from any Nova Services must be made using the appropriate level of legal process, and must be properly served on Nova via Technology Co., Limited.

13.Modification of the Agreement

We amend these terms of the Agreement from time to time, for instance when we update the functionality of our Services, when we combine multiple apps or services operated by us or our affiliates into a single combined service or app, or when there are regulatory changes. We will use commercially reasonable efforts to generally notify all users of any material changes to these terms, such as through a notice on Nova platform. However, you should look at the Agreement regularly to check for such changes. Your continued access or use of the Services after the date of the new terms constitutes your acceptance of the new terms. If you do not agree to the new terms, you must stop accessing or using the Services.

14.Copyright Complaints

Nova respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Nova of your infringement claim in accordance with the procedure set forth below. Nova will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act ("DMCA") and other applicable intellectual property laws with respect to any alleged or actual infringement. To be effective, the notification must be in writing and contain the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest; a description of the copyrighted work or other intellectual property that you claim has been infringed; a description of where the material that you claim is infringing is located on the Nova Service, with enough detail that we may find it on the Nova Service; your address, telephone number, and email address; a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf. If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to upload and use the content in your content, you may send a written counter-notice containing the following information to the Copyright Agent: your physical or electronic signature; identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled; a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the competent court located within Hong Kong and a statement that you will accept service of process from the person who provided notification of the alleged infringement. If a counter-notice is received by the Copyright Agent, Nova will send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion.

15.Other Terms

This Agreement constitutes the entire agreement of agreed items and other relevant matters between both parties. Other than as stipulated by this Agreement, no other rights are vested in either Party to this Agreement.

2. Hizmet İçeriği

Nova, kullanıcıların canlı yayın dağıtmasına, sohbet, panolar, forum gönderileri, sesli etkileşimli hizmetler gibi hizmetleri kullanmasına ve Hizmetler üzerinde içerik, mesaj, metin, ses, görüntü, uygulama, kod veya diğer veri veya materyaller oluşturma, gönderme, iletme, icra etme veya depolama faaliyetlerine katılmasına izin verebilir (“Kullanıcı İçeriği”). Hizmetlerin kullanıcıları ayrıca Nova tarafından sağlanan müzik, grafikler, çıkartmalar, sanal öğeler ve diğer özellikleri (“Nova Özellikleri”) bu Kullanıcı İçeriğinin üzerine bindirebilir ve bu Kullanıcı İçeriğini Hizmetler aracılığıyla iletebilir. Hizmetlerdeki diğer kullanıcıların (sanal hediyelerin kullanımı dahil) ifade ettiği görüşler bizim görüş veya değerlerimizi yansıtmaz.

ii. İlginizi çekebilecek içerik, ürün ve hizmetleri keşfetmenize yardımcı olmak.
Nova’yı kullanan birçok işletme ve kuruluşun sunduğu içerik, ürün ve hizmetleri keşfetmenize yardımcı olmak için size reklamlar, teklifler ve diğer sponsorlu içerikleri gösteririz.

3. Hesap

Bir hesap açmak için hesap adı ve şifre gibi belirli bilgileri sağlamanız istenebilir.

Hesabınızın ve şifrenizin gizliliğini koruma, bilgisayarınıza erişimi kısıtlama ve hesabınız veya şifreniz altında gerçekleşen tüm faaliyetlerden yalnızca sizin sorumlu olmanız gerekir. Belirli üçüncü taraf hizmetleri aracılığıyla Hizmetlere kayıt olmanıza ve oturum açmanıza izin verebiliriz. Üçüncü tarafın bilgilerinizi toplaması, kullanması ve ifşası, ilgili üçüncü taraf hizmetinin gizlilik politikasına tabidir. Nova hesabınızı herhangi bir üçüncü taraf hizmetindeki hesabınızla bağladığınızda kişisel bilgilerinizin nasıl toplandığı, kullanıldığı ve ifşa edildiği hakkında daha fazla bilgi Gizlilik Politikamızda yer alır.

Hesabınızı silmeyi seçtiğinizde, hesabınızı yeniden etkinleştiremez veya eklediğiniz içerik veya bilgileri geri alamazsınız. 4. Gizlilik

5. Hizmetlerin Kullanımı

Hizmetlere erişiminiz ve kullanımınız bu şartlara ve yürürlükteki tüm yasa ve düzenlemelere tabidir. Hizmet Şartlarına ve Nova Topluluk Kurallarına uyacağınızı ve şunları yapmayacağınızı kabul edersiniz:

i. yanlış, hukuka aykırı, ihlal eden, iftira niteliğinde, müstehcen, pornografik, mahremiyet veya tanıtım haklarını ihlal eden, taciz eden, tehdit eden, kötüye kullanan, kışkırtıcı veya başka şekilde sakıncalı içerik oluşturmak, yüklemek, iletmek, dağıtmak veya depolamak;

ii. herhangi bir kişi veya kurumu taklit etmek, herhangi bir kişi veya kurumla yanlış bağlantı iddia etmek veya başkalarının Nova hesaplarına izinsiz erişmek, başka bir kişinin kimliğini taklit etmek veya Hizmetler aracılığıyla iletilen içerik veya bilgileri sahtelemek veya benzeri dolandırıcı faaliyetlerde bulunmak;

iii. Nova kullanıcılarını iftira etmek, taciz etmek, kötüye kullanmak, tehdit etmek veya dolandırmak veya kullanıcıların veya üçüncü tarafların rızası olmadan kişisel bilgi toplamaya veya toplamaya çalışmak;

iv. Hizmetlerin veya Kullanıcı İçeriğinin güvenlikle ilgili özelliklerini kaldırmak, aşmak, devre dışı bırakmak, zarar vermek veya müdahale etmek; Hizmetler aracılığıyla erişilebilen içeriğin kullanımını veya kopyalanmasını önleyen veya kısıtlayan özellikleri; Hizmetlerin veya Kullanıcı İçeriğinin kullanımına ilişkin sınırlamaları uygulayan özellikleri; veya Hizmetler veya Kullanıcı İçeriği üzerindeki telif veya diğer mülkiyet bildirimlerini silmek;

v. Hizmetlerin veya herhangi bir bölümünün kaynak kodunu tersine mühendislik, derleme veya başka şekilde keşfetmeye çalışmak, yalnızca ikamet ettiğiniz yargı bölgesinin yasalarının açıkça izin verdiği ölçüde ve yalnızca bu faaliyet için;

vi. yürürlükteki yasanın bu sınırlamaya rağmen açıkça izin vermediği sürece, Hizmetlere veya herhangi bir bölümüne dayalı türev eserler oluşturmak, uyarlama, çevirme veya değiştirme;

vii. virüs, reklam yazılımı, casus yazılım, solucan veya diğer kötü amaçlı kod yükleme veya başka şekilde yayma dahil olmak üzere herhangi bir araçla Hizmetlerin işleyişine müdahale etmek veya zarar vermek veya herhangi bir kullanıcının bunlardan yararlanmasını engellemek;

viii. herhangi bir Kullanıcı İçeriğinin kaynağını gizlemek için tanımlayıcıları manipüle etmek;

ix. Hizmetlere veya Hizmetlere bağlı sunuculara veya ağlara müdahale etmek veya bunları kesintiye uğratmak veya bağlı ağların gereksinimlerine, prosedürlerine, politikalarına veya düzenlemelerine uymamak; Hizmetleri, diğer kullanıcıların Hizmetlerden tam olarak yararlanmasını engelleyebilecek, olumsuz etkileyebilecek veya inhibe edebilecek şekilde kullanmak veya Hizmetlerin işleyişini herhangi bir şekilde zarar verebilecek, devre dışı bırakabilecek, aşırı yükleyebilecek veya zayıflatabilecek şekilde kullanmak;

x. kullandığımız içerik filtreleme tekniklerini aşmaya çalışmak veya yetkili olmadığınız herhangi bir hizmete veya Hizmet alanına erişmeye çalışmak;

xi. Hizmetleri yasadışı amaçlarla veya fikri mülkiyet ve diğer mülkiyet hakları, veri koruma ve gizlilik dahil olmak üzere yerel, ulusal veya uluslararası herhangi bir yasa veya düzenlemeyi ihlal edecek şekilde kullanmak.

Nova, herhangi bir Kullanıcı İçeriğinden veya bundan kaynaklanan herhangi bir kayıp veya zarardan sorumluluk kabul etmez ve üstlenmez; Hizmetleri kullanırken karşılaşabileceğiniz hatalar, iftira, karalama, hakaret, ihmaller, yanlışlıklar, müstehcenlik, pornografi veya küfür için Nova sorumlu tutulamaz. Hizmetleri kullanımınız kendi riskinizdedir. Ayrıca bu kurallar, herhangi bir üçüncü taraf lehine özel bir dava hakkı yaratmaz veya Hizmetlerin bu kurallarca yasaklanan içerik içermeyeceğine dair makul bir beklenti oluşturmaz.

Nova, Kullanıcı İçeriğinde yer alan beyan veya temsillerden sorumlu değildir. Nova herhangi bir Kullanıcı İçeriğini, görüşü, tavsiyeyi veya orada ifade edilen tavsiyeyi onaylamaz ve Kullanıcı İçeriğiyle bağlantılı olarak tüm sorumlulukları açıkça reddeder. Yürürlükteki yasanın izin verdiği azami ölçüde, Nova, Hizmetlerde yayınlanan veya saklanan herhangi bir Kullanıcı İçeriğini bu Hizmet Şartlarını veya yürürlükteki yasayı ihlal ettiği durumlarda dahil olmak üzere herhangi bir zamanda ve bildirimde bulunmaksızın kaldırma, eleme veya düzenleme hakkını saklı tutar ve yedekleme kopyaları oluşturma ve Hizmetlerde yayınladığınız veya sakladığınız herhangi bir Kullanıcı İçeriğini yalnızca kendi maliyetinizde ve yükümlülüğünüzde değiştirme yükümlülüğü yalnızca size aittir. Yukarıdakilerin ihlali, Hizmetlerin Kullanım Şartlarını ihlal eder ve aralarında Hizmetleri kullanma haklarınızın sona erdirilmesi veya askıya alınması da dahil sonuçlar doğurabilir.

6. Sanal Öğeler

Sanal Paraları (“Paralar”) ve sanal hediyeleri (Hediyeler) yalnızca 16 yaşında (veya yargı bölgenizde reşitlik yaşında) veya daha büyük iseniz satın alabilir, başkalarına Hediye gönderebilir, parasal değeri olan Hediyeler alabilir, sanal fasulyeler (“Fasulyeler”) kazanabilir ve çekebilirsiniz.

Paraların fiyatı satın alma noktasında gösterilir. Paralar için tüm ücretler ve ödemeler, ilgili ödeme mekanizması aracılığıyla satın alma noktasında belirtilen para biriminde yapılır. Kur çözümleri, yabancı işlem ücretleri ve ödeme kanalı ücretleri varsa, geçerli ödeme sağlayıcınızla yaptığınız anlaşmaya dayanır.

Satın aldığınız Paralardan ödeme yükümlülüğünden yalnızca siz sorumlusunuz. Satın alma tamamlandığında kullanıcı hesabınıza Paralar yüklenir. Paralar Hediye satın almak için kullanılabilir. Paralar nakit, yasal para veya herhangi bir devlet, bölge veya siyasi varlığın para birimi veya başka bir kredi biçimiyle değiştirilemez. Paralar yalnızca Nova’da ve Hizmetlerimizin parçası olarak kullanılabilir ve tarafımızca belirlenenler dışında diğer promosyonlar, kuponlar, indirimler veya özel tekliflerle birleştirilemez veya birlikte kullanılamaz.

Bu Sözleşmede aksine düzenlenmedikçe, Paralar ve Hediyelerin tüm satışları kesindir ve satın alınan Paralar ve Hediyeler için iade sunmayız. Paralar ve Hediyeler nakde çevrilemez veya değiştirilemez ve herhangi bir nedenle tarafımızca iade edilemez veya geri ödenemez.

7. Ödeme Şartları

Ödeme yöntemi olarak zaman zaman sitemiz aracılığıyla size sunabileceğimiz başlıca kredi kartları, belirli banka kartları ve/veya diğer ödeme yöntemlerini kabul ederiz. Seçtiğiniz ödeme yönteminin tüm şartlarına tabisiniz. Hizmet üzerinden bir sipariş göndererek, satın alma tutarı için belirttiğiniz hesabı bizim veya belirlenmiş ödeme işlemcimizin tahsil etmesine yetki verirsiniz. Tüm ödemeler, Nova tarafından sunulan ödeme yöntemleri aracılığıyla başka para birimleri sunulmadığı sürece ABD Doları cinsinden yapılır.

Ödeme işleme ortaklarımız, ödemeyi finansal kurumları aracılığıyla yapmak ve yürürlükteki uluslararası, ulusal, federal, eyalet ve yerel yasa ve düzenlemelere uymak amacıyla belirli kişisel veriler (ör. geçerli bir devlet kimliği, yasal adınız, adresiniz ve doğum tarihiniz) sağlamanızı isteyebilir. Ödeme ile ilgili herhangi bir sorun hakkında doğrudan sizinle iletişim kurabilirler.

Bir satın alma, ödeme yönteminizle ilgili sorunlar nedeniyle çevrimiçi olarak reddedildiyse, tüm verilerin doğru olduğundan emin olun ve yeniden gönderin. İşlem çevrimiçi olarak kabul edilmezse, satın alma ile bağlantılı olarak size sunulan e-posta adresi üzerinden müşteri desteğiyle iletişime geçin. 8. Fikri Mülkiyet Hakları

Nova tarafından Hizmetler içinde sağlanan tüm metin, veri, görüntü, grafik, ses ve/veya video bilgisi ve diğer materyaller Nova’nın mülkiyetindedir ve telif, marka ve/veya diğer mülkiyet hakları yasalarıyla korunur. Bu Sözleşmede hiçbir şey, Nova’dan size herhangi bir fikri mülkiyet hakkı lisansı verildiği şeklinde yorumlanamaz.

Nova Hizmetleri aracılığıyla canlı yayın içeriği veya diğer içeriği kullanarak ve/veya yükleyerek Nova web sitesinin herkese açık alanlarına, Nova’ya ve alt lisans verilenlere, herhangi bir bölgesel veya zaman sınırı olmaksızın ve onay ve/veya tazminat gerektirmeksizin, böyle içeriği kullanma, kopyalama, değiştirme, uyarlama, yayımlama, çevirme, düzenleme, tasarruf etme, türev eserler oluşturma, dağıtma, icra etme ve kamuya gösterme (tamamı veya bir kısmı) ve/veya böyle içeriği mevcut veya gelecekteki çalışma, medya veya teknoloji biçimlerine dahil etme izni, ücretsiz, kalıcı, geri alınamaz, münhasır olmayan ve tam alt lisanslanabilir haklar ve lisans verirsiniz.

9. Hizmetlerin Sonlandırılması

Yürürlükteki yasanın izin verdiği azami ölçüde, Nova, bildirimde bulunmaksızın ve mutlak takdirine bağlı olarak, Hizmetleri kullanma lisansınızı (Kullanıcı İçeriği gönderme dahil) sonlandırma ve gelecekte Hizmetlere erişiminizi ve kullanımınızı engelleme veya önleme hakkını saklı tutar; makul olarak şunları düşündüğümüz durumlarda dahil: (a) Hizmetlerin kullanımınız bu Sözleşmeyi veya yürürlükteki yasayı ihlal eder; (b) Hizmetleri dolandırıcı şekilde kullanırsınız veya kötüye kullanırsınız; veya (c) teknik veya meşru iş nedenleriyle size Hizmet sunmaya devam edemeyiz. Bu, satın alınan ürün veya hizmetlere erişiminizi sonlandırma veya askıya alma yeteneğini içerir. Yürürlükteki yasanın izin verdiği azami ölçüde, (i) Hizmetler, (ii) bu Hizmet şartlarının herhangi bir hükmü, (iii) Nova’nın Hizmetleri işletme politikası veya uygulaması veya (iv) Hizmetler aracılığıyla iletilen herhangi bir içerik veya bilgi ile ilgili memnuniyetsizliğinize karşı tek çareniz, hesabınızı sonlandırmak ve Hizmetlerin tüm bölümlerinin kullanımını durdurmaktır.

10. Sorumluluk Reddi

Nova Hizmetlerini kullanmaya ilişkin risklerden tamamen siz sorumlusunuz. Nova Hizmetlerini herhangi bir şekilde kullanmak veya bunlara güvenmek tamamen kendi riskinizdedir.

Hiçbir durumda Nova, Hizmetlerin gereksinimlerinizi karşılayacağını garanti etmez veya Hizmetlerin kesintisiz olacağını garanti etmez. Hizmetlerin zamanlılığı, güvenliği ve doğruluğu da garanti edilmez. Hizmetlerin “olduğu gibi” sunulduğunu kabul edersiniz. Nova, bu tür Hizmetlerin veya herhangi bir bölümünün işletilmesi ve sunulması konusunda açık veya zımni hiçbir beyan veya garanti vermez. Nova, Hizmetlerin kalitesinden, zamanlılığından, doğruluğundan veya eksiksizliğinden hiçbir şekilde sorumlu tutulamaz ve bu tür Hizmetleri kullanmanızdan doğabilecek sonuçlardan sorumlu değildir.

Nova, Hizmetleri kullanarak erişilebilir harici bağlantıların doğruluğunu ve bütünlüğünü garanti etmez veya kolaylığınız için yerleştirilmiş harici bağlantıların doğruluğunu garanti etmez. Bağlantılı bir sitedeki veya bağlantılı bir sitedeki herhangi bir bağlantıdaki içerikten Nova sorumlu tutulmaz ve Hizmetleri kullanımınızla bağlantılı herhangi bir kayıp veya zarardan doğrudan veya dolaylı olarak sorumlu veya yükümlü tutulamaz. Ayrıca, Nova’nın kontrolü altında olmayan bir harici bağlantı aracılığıyla yönlendirildiğiniz herhangi bir web sayfasının içeriğinden sorumluluk üstlenmez.

Nova, mücbir sebepler veya başka şekilde kontrolü dışındaki koşullar nedeniyle Hizmetlerin kesintiye uğraması veya diğer yetersizlikleri için hiçbir sorumluluk üstlenmez. Bununla birlikte, mümkün olduğunca, size olan kayıpları ve etkiyi makul şekilde en aza indirmeye çalışırız.

11. Yasal Yargı Yetkisi

Bu Sözleşme, Hong Kong yasalarına tabi olacak ve bu yasalara göre yorumlanacaktır.

12. Bilgi talebi

Olası, beklenen veya mevcut yasal süreçler, soruşturmalar veya anlaşmazlıklar veya üçüncü taraf kullanıcı bilgileriyle ilgili herhangi bir Nova Hizmetinden bilgi veya belge taleplerinin tümü, uygun yasal süreç düzeyi kullanılarak yapılmalı ve Nova Technology Co., Limited üzerinden usulüne uygun şekilde tebliğ edilmelidir.

13. Sözleşmenin Değiştirilmesi

Bu Sözleşme şartlarını zaman zaman değiştiririz; örneğin Hizmetlerimizin işlevselliğini güncellediğimizde, tarafımızca veya bağlı kuruluşlarımızca işletilen birden fazla uygulama veya hizmeti tek bir birleşik hizmet veya uygulamada birleştirdiğimizde veya düzenleyici değişiklikler olduğunda. Bu şartlardaki önemli değişiklikleri genellikle Nova platformunda bir bildirim gibi ticari olarak makul çabalarla tüm kullanıcılara bildiririz. Bununla birlikte, bu tür değişiklikleri kontrol etmek için Sözleşmeyi düzenli olarak gözden geçirmelisiniz. Yeni şartların tarihinden sonra erişiminize veya kullanımınıza devam etmeniz, yeni şartları kabul ettiğiniz anlamına gelir. Yeni şartları kabul etmiyorsanız, Hizmetlere erişimi veya kullanımı durdurmalısınız.

14. Telif Şikayetleri

Nova, başkalarının fikri mülkiyetine saygı duyar ve kullanıcılarımızdan da aynısını yapmalarını isteriz. Eserinizin telif hakkı ihlali oluşturacak şekilde kopyalandığına veya fikri mülkiyet haklarınızın başka şekilde ihlal edildiğine inanıyorsanız, aşağıda belirtilen prosedüre uygun olarak Nova’ya ihlal iddianızı bildirmelisiniz. Nova, iddia edilen ihlallere ilişkin bildirimleri işleyecek ve soruşturacak ve herhangi bir iddia veya fiili ihlal ile ilgili olarak yürürlükteki fikri mülkiyet yasaları kapsamında uygun eylemlerde bulunacaktır. Bildirimin geçerli olması için yazılı olması ve şu bilgileri içermesi gerekir: telif veya diğer fikri mülkiyet menfaatının sahibi adına hareket etmeye yetkili kişinin elektronik veya fiziksel imzası; ihlal edildiğini iddia ettiğiniz telifli eser veya diğer fikri mülkiyetin açıklaması; ihlal edildiğini iddia ettiğiniz materyalin Nova Hizmetinde nerede bulunduğunun, bulmamız için yeterli ayrıntıyla açıklaması; adresiniz, telefon numaranız ve e-posta adresiniz; anlaşmaz kullanımın telif veya fikri mülkiyet sahibi, vekili veya yasa tarafından yetkilendirilmediğine dair iyi niyetle inandığınıza dair beyanınız; ve yukarıdaki bilgilerin doğru olduğuna ve telif veya fikri mülkiyet sahibi veya hareket etmeye yetkili olduğunuza dair yeminli ifade altında beyanınız. Kaldırılan (veya erişimi devre dışı bırakılan) içeriğinizin ihlal etmediğine veya telif sahibinden, vekilden veya yasaya göre içeriği yüklemek ve kullanmak için yetkiniz olduğuna inanıyorsanız, Telif Aracısına yazılı bir karşı bildirim gönderebilirsiniz: fiziksel veya elektronik imzanız; kaldırılan veya erişimi devre dışı bırakılan içeriğin tanımlanması ve içeriğin kaldırılmadan veya devre dışı bırakılmadan önce göründüğü konum; içeriğin hata veya yanlış tanımlama sonucu kaldırıldığına veya devre dışı bırakıldığına dair iyi niyetle inandığınıza dair beyanınız; adınız, adresiniz, telefon numaranız ve e-posta adresiniz; Hong Kong’daki yetkili mahkemenin yargı yetkisine rıza gösterdiğinize ve bildirimi sağlayan kişiden süreç tebliğini kabul edeceğinize dair beyanınız. Telif Aracısına bir karşı bildirim alınırsa, Nova, karşı bildirimin bir kopyasını asıl şikayetçiye göndererek, o kişiye 10 iş günü içinde kaldırılan içeriği değiştirebileceğini veya devre dışı bırakmayı durdurabileceğini bildirir. Telif sahibi içerik sağlayıcı, üye veya kullanıcıya karşı mahkeme kararı talep eden bir dava açmadığı sürece, kaldırılan içerik değiştirilebilir veya erişimi, karşı bildirimin alınmasından sonra 10 ila 14 iş günü veya daha sonra, mutlak takdirimize bağlı olarak geri yüklenebilir.

15. Diğer Şartlar

Bu Sözleşme, taraflar arasında üzerinde anlaşılan maddeler ve diğer ilgili konular açısından tüm anlaşmayı oluşturur. Bu Sözleşmede düzenlenenler dışında, bu Sözleşmenin tarafı olan hiçbir tarafa başka haklar tanınmaz.
